Terms and conditions of sale

1. Seller

The site davyn1371.co.uk is operated by Savonnerie Davyn (hereinafter ‘the Maison’), whose registered address is 49 cours Mirabeau, 13100 Aix-en-Provence (France). E-mail: contact@davyn1371.co.uk. Company registration details and the VAT number appear on the Legal notice page.

2. Purpose and acceptance

These terms and conditions of sale govern all sales of products concluded on the site davyn1371.co.uk between the Maison and any consumer (hereinafter ‘the Customer’). Every order implies acceptance of these terms in the version in force on the date of the order. The terms accepted at the time the order is confirmed shall prevail.

3. Products

The products offered for sale are described as accurately as possible. Photographs and illustrations are not contractually binding. Offers are valid for as long as they are shown on the site and while stocks last. Should a product be unavailable after an order has been placed, the Customer is informed without delay and refunded any sums paid.

4. Prices

Prices are shown in pounds sterling (£), including UK VAT and excluding delivery charges. Import VAT and any duties are collected at checkout; nothing further is payable on delivery. Delivery charges are shown before the order is confirmed. Products are invoiced at the price in force at the time the order is confirmed.

5. Ordering

The Customer places the order directly on the site. The process comprises choosing the products, checking the basket, entering contact details and the delivery address, choosing the payment method and, finally, definitive confirmation after reading these terms. The Customer receives a confirmation e-mail summarising the order. The contract of sale is deemed concluded when that confirmation is sent. The Maison reserves the right to refuse any abnormal order or any order placed in bad faith.

6. Payment

Payment is made online, at the time of ordering, by credit or debit card (Visa, Mastercard, American Express), Apple Pay, Google Pay or PayPal. With PayPal, the Customer may also pay in 3 interest-free instalments, subject to PayPal’s approval and terms; the payment schedule is shown at checkout. Transactions are processed securely by the payment service providers; the Maison never has access to the Customer’s bank details. The order is dispatched once payment has been received.

7. Delivery

Products are delivered exclusively within Great Britain – England, Scotland and Wales (no delivery to Northern Ireland, the Channel Islands or the Isle of Man) – to the InPost Locker or Shop nearest to the address given by the Customer. Delivery costs £5.90 for orders under £99; from £99, delivery is free. Parcels are prepared within 24 working hours and handed to the carrier for tracked delivery in 3–5 working days. In any event, delivery takes place no later than thirty days after the order. Risk of loss of or damage to the products passes to the Customer when the Customer, or a third party designated by the Customer, takes physical possession of them. Any anomaly noticed on collection (damaged parcel, missing product) should be reported to the Maison as soon as possible.

8. Right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Customer has fourteen days from the day after receiving the product to exercise the right to cancel, without giving any reason and without any penalty. Cancellation is notified by e-mail to contact@davyn1371.co.uk, by using the form in the annex, or by any other clear statement.

The Maison refunds all sums paid, including standard delivery charges, no later than fourteen days after the day on which it is informed of the decision to cancel, using the same payment method as for the order. The Maison does not require the product to be returned; should the Customer nonetheless decide to send it back, the cost of return is borne by the Customer.

9. 30-day money-back guarantee

Independently of the statutory right to cancel, the Maison undertakes to refund in full any Customer who, within thirty days of delivery, writes to say that they are not satisfied with the product. Neither a reason nor a return is required. This commercial guarantee is in addition to the Customer’s statutory rights and does not replace them.

10. Statutory rights

The Maison is responsible for any lack of conformity of the products in accordance with the Consumer Rights Act 2015: the products must be as described, fit for purpose and of satisfactory quality. Where they are not, the Customer is entitled, as provided by the Act, to a repair or replacement of the product or, in the cases it sets out, to a price reduction or a refund. These rights apply independently of the commercial guarantee in article 9. To exercise them, the Customer writes to contact@davyn1371.co.uk.

11. Liability

The products are intended for household use, in accordance with the instructions on the packaging. The Maison cannot be held liable for damage resulting from improper use, nor for non-performance of the contract in the event of force majeure.

12. Personal data

The processing of personal data and the Customer’s rights are described on the Privacy & data page.

13. Intellectual property

All elements of the site and of the products (texts, images, trade marks, illustrations, seals, monogram) are the exclusive property of Savonnerie Davyn. Any reproduction without prior written permission is prohibited.

14. Complaints and dispute resolution

Complaints should be addressed to client service: contact@davyn1371.co.uk (Monday to Friday, 9am to 5pm (UK time)). Should a complaint not be resolved, the Maison will provide the Customer with information on the competent alternative dispute resolution (ADR) body for consumer disputes, stating whether it subscribes to it.

15. Governing law and jurisdiction

These terms are governed by French law. This choice does not deprive the Customer of the protection afforded by the mandatory provisions of the law of the country in which the Customer is habitually resident. For any dispute, the courts of the place of residence or domicile of the consumer Customer have jurisdiction.
